Terms Of Service
Welcome to the web site operated by Equus Unlimited. (the “Game”), accessible at www.equusunlimited.yolasite.com and http://equusureboot.freeforums.org. “Site” means web sites of the Game and its affiliates, including any web sites on which these terms and conditions of use are posted. The “Site” may include access to virtual environments, games and other content, as well as downloadable software. All users of the Site are subject to the following terms and conditions of use (these “Terms of Use”).
Please read these Terms of Use carefully before
accessing or using any part of this Site. By
accessing or using this Site, you agree that you have read, understand and
agree to be bound by these Terms of Use, as amended from time to time, as well
as the Game Privacy Policy, which is hereby incorporated
into these Terms of Use. If you do not wish to agree to these Terms of Use, do
not access or use any part of this Site.
The Game may revise and update these Terms of Use
at any time without notice by posting the amended terms to this Site. Your
continued use of the Site means that you accept and agree to the revised Terms
of Use. If you disagree with the Terms of Use (as amended from time to time) or
are dissatisfied with this Site, your sole and exclusive remedy is to
discontinue using this Site. It is your responsibility to regularly check the
Site to determine if there have been changes to these Terms of Use and to
review such changes.
USE OF THE SITE
You agree to use the Site only for lawful
purposes:
(a) Specifically you agree not to do any of the
following: (1) upload to or transmit on the Site any defamatory, indecent, obscene,
harassing, violent or otherwise objectionable material, or any material that
is, or may be, protected by copyright, without permission from the copyright
owner; (2) use the Site to violate the legal rights (including the rights of
publicity and privacy) of others or to violate the laws of any jurisdiction;
(3) intercept or attempt to intercept electronic mail not intended for you; (4)
misrepresent an affiliation with any person or organization; (5) upload to or
transmit on the Site any advertisements or solicitations of business; (6)
restrict or inhibit use of the Site by others; (7) upload or otherwise transmit
files that contain a virus or corrupted data; (8) collect information about
others (including e-mail addresses) without their consent; (9) download a file
or software or include in a message any software, files or links that you know,
or have reason to believe, cannot be distributed legally over the Site or that
you have a contractual obligation to keep confidential (notwithstanding its
availability on the Site); (10) post “spam,” transmit chain letters or engage
in other similar activities; (11) solicit personal information from anyone
under 18 or solicit passwords or personally identifying information for
commercial or unlawful purposes; (12) “stalk,” abuse or harass another user, or
attempt to do any of the foregoing; or (13) engage in any other conduct that
restricts or inhibits anyone’s use or enjoyment of the Site, or which, as
determined by the Game, may harm the Game or users of the Site or expose them
to liability. Without limiting any of the foregoing, you also agree to abide by
any code of conduct applicable to the Site or any service available on the
Site.
(b) Any content and/or opinions uploaded,
expressed or submitted to a message board, blog, chatroom or any other publicly
available section of the Site (including password-protected areas), and all
articles and responses to questions, other than the content provided by the Game,
are solely the opinions and responsibility of the person or entity submitting
them and do not necessarily reflect the opinions of the Game. You understand
and acknowledge that you are responsible for whatever content you submit, and
you, not the Game, have full responsibility for such content, including its
legality, reliability and appropriateness. By uploading or otherwise
transmitting material to any area of the Site, you warrant that the material is
your own or is in the public domain or otherwise free of proprietary or other
restrictions and that you have the right to post it to the Site. You grant to
the Game the right to use all content you upload or otherwise transmit to the
Site in any manner the Game chooses, including, but not limited, to copying,
displaying, performing or publishing it in any format whatsoever, modifying it,
incorporating it into other material or making a derivative work based on it.
(c) The Game reserves the right, but does not
assume any responsibility, to (1) remove any material posted on the Site which the
Game, in its sole discretion, deems inconsistent with the foregoing commitments
(including any material that the Game has reason to believe constitutes, or for
which the Game has received notice of its constituting, a copyright
infringement); and (2) terminate any user’s access to all or part of the Site.
However, the Game can neither review all material before it is posted on the
Site nor ensure prompt removal of objectionable material after it has been
posted. Accordingly, the Game assumes no liability for any action or inaction
regarding transmissions, communications or content provided by third parties.
The Game reserves the right to take any action it deems necessary to protect
the personal safety of users of this Site and the public; however, the Game has
no liability or responsibility to anyone for performance or nonperformance of
the activities described in this paragraph.
(d) Your failure to comply with the provisions of
(a) or (b) above may result in the termination of your access to the Site and
may expose you to civil and/or criminal liability.
Rules of Conduct
1. Equus Unlimited (Hereafter known as "EU") is created and maintained for entertainment purposes only. All contents found are completely fictional unless specifically stated otherwise, and any resemblance to actual persons, horses, events, companies, stables, barns, properties, breeding operations, farms or any other type of related business is purely coincidental.
2. No hotlinking to images that are hosted by someone else or another site. Image will immediately be removed. If you would like to post pictures, its suggested that you upload them to photobucket.com or a similar hosting service. Additionally, any pictures of any real life horses can be used ONLY with the website/horse owner's WRITTEN permission. If you cannot obtain WRITTEN permission to use the picture(s), don't put it on your website or use it for your sim horse. We'll ask you to remove it or remove it ourselves and not allow the use of it again. The only exclusions to this would be pictures released under common use type licences, copyright free photo sites, pictures YOU take yourself, or in some cases, classified equine ad sites, such as dreamhorse.com.
3. No double playing. One account per person. We check IP's without publically announcing it.
4. The EU Administrative Staff has the right to disallow anyone from joining EU and ban/prevent members who violate the rules from playing for however long duration deemed appropriate. We also reserve the right to impose a permanent ban on any member that repeatedly breaks these rules.
5. All parts of this game are offered to all participants free of charge. Nor does the owner of EU profit in any way shape or form from any of EU's websites, forums, or placed advertising. She does this solely because she wants to.
6. All participants are expected to act in a manner which is acceptable to young children and the general public at all times. This includes, but is not limited to, obeying language restrictions, conducting oneself in a manner that is respectful to the Owner and Staff and other members, and not disturbing the general well being of the "club" atmosphere. As stated above, we expect a "G-Rated" atmosphere at all times.
This means topics of conversation that would generally NOT be allowed in a public school elementary level (K-8) classroom are not allowed here. These topics include but are not limited to: Drugs (street / illegal and prescription both), Sex or Sexual Matters, Violence, Threatening others on the board with in any manner whatsoever, Threatening others in Real Life in any manner whatsoever, or any other topics that the staff and/or other members find to violate the "G-Rated" atmosphere. Staff members have the final decision on any controversial topics such as religion, politics, and current affairs.
Also, "trolling", "flaming" and any other type of similar behavior is expressly forbidden on the EU game forums.
7.EU operates on a time frame that ages its horses. One sim year is equal to one real life year. EU's horses age one year older on January 1st. For more information, please read the Aging Section of the Rules.
8. EU does allow its members to breed horses. NO FORCE BREEDING, NO GRAPHIC or SUGGESTIVE language allowed! Keep it clean for minors. Any questions? Email staff please.
Force Breeding is when "player A" uses a horse owned by "player B" as a parent to a foal they wish to create without "player B's" permission or knowledge. This is the sim game equivalent to stealing the horse in real life, breeding the stolen horse in secret, and returning the horse without the owners knowledge. This is prosecutable in most states as theft, and the resulting foal often is NOT allowed to be registered with most breed registries.
9. EU allows kids 14 - 17 to join. We do not allow 13 and younger please. Under and Including 14 - Parental permission is required to play. 15 - 17 - not unless we feel that you are not representing your age truthfully. Over 18? Come on in. Please read the Privacy Policy for further information.
10. All other rules (no matter where they are listed) must be respected and followed.
Privacy Policy
Equus Unlimited (hereafter known as “EU”) is committed to
protecting and safeguarding consumer privacy on the Internet, especially for minors.
This privacy policy (“Privacy Policy”) describes how we handle the personal
information provided to us on this website and collected through the in-game
play of the EU environment (collectively “Site”), accessible from www.EquusUnlimited.yolasite.com. The
EU environment includes, but is not limited to, its websites, community message
boards, and chat rooms.
Please be sure to read this Privacy Policy before
using this Site or submitting information to us. Our Privacy Policy may change
from time to time and your continued use of this Site constitutes acceptance of
such changes, so please check this area periodically for updates to this
Privacy Policy.
EU is very sensitive to privacy issues with
respect to minors, especially those under the age of 13. Please see below for
more information on how EU addresses minor’s privacy issues generally and under
the Children’s Online Privacy Protection Act (“COPPA”). We encourage parents to
regularly monitor and supervise their child’s on-line activities.
INFORMATION EU COLLECTS FROM YOU
EU collects information through your active
submission of information only. Please note: see the Section below titled
“Special Notes about Information from Minors” for the process we use to limit
information collected from minors under the age of the 13.
Active Information Collection
Much of the personally identifiable information we
collect from our visitors is submitted by visitors in response to our requests,
such as during the registration process, or in response to polls, forums, or
other interactivity incorporated into the site. From time-to-time, visitors may
also submit personally identifiable information directly to us via e-mail. The
information we actively collect includes some or all of the following:

During the registration process, we will also
collect a parent’s or guardian’s e-mail address from potential members if they are 14 years of age or younger, or if their parent(s) elect to set up a parental account. Establishment of
a parental account may also require submission of the information described in
this Section with respect to the parent(s) or guardian(s).
We will never ask for the following information:
addresses, phone numbers, school information, parent’s personal information
(with the exception of the information listed above), social security
numbers, or any other personally identifiable info such as race, or background.
We will also never ask for a player's password for the forum. We do not need it as the admin can reset a player's password from the admin controls, or the player can request a password reset to whatever email address they provided upon registration. If the admin is required to reset the member's password from the control panel, that member will immediately be instructed to log in, and then change the password again so as that the admin will not have members' password. This is in accordance and compliance with federal PCI laws.
Passive Information Collection
As you navigate through the Site and participate
in the EU environment, other information may be collected through use of
technologies which are common among websites and online environments. For
example, the message board or forum we currently use tracks IP addresses, uses
session cookies, and evaluates access time and navigational data in connection
with the Site. This is not EU’s choice, but part of the TOS of the forum we choose to use for game purposes. “Cookies” are small
pieces of information or files that a website puts on your computer which allow the forum to accumulate data on your navigation of the forum and ease such
navigation (e.g., by allowing your computer to save your Username and
Password). Within the EU environment, we may also collect information on your
in-game activities, such as game development and character interaction.
In addition, we do not use technology to passively
gather operational information about the technology you use, such as your
browser, type of computer, operating systems and Internet service providers. EU does not need it, nor do we care.
HOW EU USES YOUR INFORMATION
EU uses your personal information to enable you to
register for the Site. We also use this information to manage your use of the
Site and support operation of the Site generally. We may also use your personal
information to send you general updates and information about the Site and EU’s
game updates and services.
We do not give, provide, or sell your personal information to third
parties, for any reason what so ever, and never have.
We reserve the right to disclose information if
required to do so by law or by a regulatory authority. We may also disclose
your information as part of an investigation or enforcement action relating to
improper or illegal conduct in connection with our Site.
If a third party acquires the assets of EU related
to the Site and its products and services (whether by sale, merger, change of
control, bankruptcy or otherwise), your information may be transferred to the
new owner(s). In such case, your information would remain subject to the
provisions of the privacy policy that was applicable to your information
immediately prior to the transfer.
EU may maintain aggregate data or other
non-personally identifiable information about our users, such as usage
statistics, online traffic patterns and user feedback. In addition to using
this information to support operation of the Site, EU may disclose this
information to third parties without restriction.
SPECIAL NOTES ABOUT INFORMATION FROM MINORS
On our Site, we offer many features, such as the
ability to view or download game content or images, news, or participate in
forums, which do not require a minor to provide any personal information other
than the registration information required by the forum. EU will not
condition a minor’s participation in any online activity on the minor’s
disclosure of more personal information than is reasonably necessary to
participate in that activity. We also may enable users to chat online through
our Site, but we take measures to limit users’ ability to communicate personal
information through this chat function.
Minors Under the Age of 13
EU does not allow minors under the age of 13 to join or play. The youngest we allow to join is 14. Any minors 14 years old (or younger) MUST have parental permission to play EU.
During the registration process, we collect only
limited personal information from minors identified as 14 years of age
(such as username and password) as well as an e-mail address or other contact
information for a parent or guardian, when required. We obtain this information so that we can
notify the parent or guardian and obtain his or her electronic consent prior to
completing the registration process. We will not knowingly accept registration from a minor
younger than 13.
Parental Review of Personally Identifiable
Information
If, at their request, the parent(s) will have the
ability to set up parental accounts to monitor their minors accounts and
review the personally identifiable information maintained by EU from such
accounts. If a minor is under the age of 14, the minor will be required to
submit an e-mail address for a parent or guardian and such individual will have
the opportunity to set up a parental account. Alternatively, parents or
guardians may establish a parental account during the initial registration
process for the minor’s account or, subsequently, through the account
management features applicable to the minor’s account. Although a minor over
the age of 15 may register without the electronic consent of a parent or
guardian, a parent or guardian of any aged minor may also submit a request to EU at the contact
information below to review any personally identifiable information from such minor.
However, such requests may be subject to the parent or guardian demonstrating
proper identification to EU’s satisfaction after reasonable investigation.

INFORMATION
You have the following choices regarding the
personally identifiable information you provide for EU to use:

to request access to review, correct or
delete any personally identifiable information maintained on our systems that
you or your minor has provided to us through the Site registration process or
other request. To protect your privacy, we will respond only to e-mail messages
sent from the e-mail account that you specified (or was given by your minor)
during the account registration process.
You may also opt out of receiving newsletters and
other promotional materials from EU by notifying us at admin.equus@gmail.com.
If you do not wish us to collect cookies, you may
set your browser to refuse cookies, or to alert you when cookies are being
sent. If you do so, please note that some parts of this Site may then be
inaccessible or not function properly.
HOW EU PROTECTS YOUR INFORMATION
We work hard to protect your personal information.
We use both technical and procedural methods to maintain the integrity and
security of our databases, including giving users a unique user name and
password for access to the Site, SSL encryption for data transfer, firewalls,
and restricted access to data.
However, the safety and security of your
information also depends on you. You should never share your password with
anyone else and you should always logoff before leaving your computer. If you
believe someone has unauthorized access to your password or account, please

EFFECTIVE DATE; CHANGES
This Privacy Policy is effective as of January 1,
2010, was last updated on 10/02/2012, and applies to all information previously obtained by EU. EU reserves the
right to change its privacy policy in its sole discretion. In such case, EU
will post the new privacy policy on the Site and the effective date of the new
privacy policy will be clearly marked. With respect to minors under the age of
14, EU will not use personally identifiable information from such minors in
ways that are materially different from this version of the Privacy Policy
unless the parent(s) or guardian(s) are notified of, and consent to, the new
changes to the privacy policy.

DISCLAIMER
You understand and agree Equus Unlimited (EU) is completely and wholly fake, operating under the
category of simulation gaming. EU, its forums, websites, and any other websites that claim to be a part of
EU as a whole entity, is based off of the imaginations of its members in that all horses, barns, stables, farms,
and member websites are totally and completely 100% fake. EU’s Members create, show, buy and sell,
make believe horses in a gaming scenario. EU nor its owner / staff does not currently, has not in the past,
and will not in the future intend on making money / profiting from any of its members, the content of the
game, or advertising contained within its collective websites and forums.
Further more, EU is not responsible for and does not condone the use of any unauthorized pictures of real
life horses used to represent fake/made up horses. EU asks that its members ask for permission to use any
pictures from the owner of the website or owner of the horse in question BEFORE using said pictures on
any websites. EU attempts to control the usage of and disallow any pictures used in an unauthorized fashion
but EU cannot be responsible for the actions of its members and is not responsible for the actions of its
members. Any pictures, images, or graphics other than the the ones included with the website html used on
EU’s representative web pages or forums will not contain unauthorized images, and in all cases is the
original artwork of Beth Cain.
